The BPTO has published a new transition rule applicable to the examination of industrial design registration applications, due to the entry into force of the second edition of the Industrial Designs Manual.
The change was formalized through Normative Ordinance BPTO/PR No. 69/2026, published in the Official Gazette of the Union and in the Industrial Property Gazette (RPI) No. 2889.
Under the new rule, the BPTO may continue applying the guidelines of the first edition of the Manual in certain cases, especially for applications filed up to 60 days after the entry into force of the new edition and for examinations related to office actions issued during the previous period.
The measure aims to ensure greater legal certainty and avoid harm to the claimed protection, reflecting the dialogue held between the Institute and the various stakeholders of the intellectual property system.
