On 06/02/2021, Complementary Law No. 182/2021, known as the New Startups Act, was approved by the Parliament. In addition to regulating the activities of angel investors and establishing tax and public bidding benefits, the new legislation regulates that Startups may file trademark and patent applications through the Redesim portal. Furthermore, companies that are part of the Inova Simples regime will also enjoy priority in the analysis of their applications.
Those companies that meet the requirements of being “newly-born or in recent operation, whose performance is characterized by innovation applied to a business model, or to products or services offered”, with gross revenue of up to R$ 16,000,000.00 in the previous calendar year (or R$1,333,334.00 multiplied by the number of months of activity in the previous year, when less than 12 months); that do not exceed 10 years of registration with the CNPJ and that have the declaration in their constitutive or amending act and use of innovative business models for the generation of products or services, pursuant to item IV of the caput of art. 2 of Law No. 10973, of December 2, 2004; or framed in the special regime Inova Simples; will be entitled to the benefit.
