BPTO releases third edition of its trademarks guidelines

The Brazilian Patent and Trademark Office (BPTO) released in its website the third edition of its trademarks guidelines. It will enter into force in October 2nd, 2019.

In the same date, the Madrid Protocol – an international treaty that allows for the international registration of trademarks – will enter into force in Brazil. In view of that, the biggest update of the guidelines is the creation of a specific chapter about that topic.

Other updates were made in other chapters of the document due to changes promoted by Brazil’s adherence to the Madrid Protocol.  Some procedure innovations were also implemented in view of the Madrid Protocol. It can be mentioned the possibility of co-ownership of a trademark, as well as filing a multi-class trademark application.

The BPTO’s trademark guidelines is an important tool that allows for a better uniformity in the administrative decisions of trademark examiners.
