Brazilian PTO announces that the limit of PPH requests for Patent Applications of the Section H were reached

The Brazilian PTO informed on June 30, 2022, that the limit of 150 requests of the PPH (Patent Prosecution Highway) Pilot Program for patent applications classified in section H according to International Patent Classification (IPC) for the year of 2022 was achieved. The section H encompasses, among others, technical areas such as electrical, telecommunications, basic electrical elements, material selection, electrical and magnetic properties, structural associations.

According to Ordinance INPI/PR n° 13 of April 01, 2022, which established the beginning of phase III of the Patent Prosecution Highway (PPH) Pilot Program, up to 800 (eight hundred) requests may be applied, considering all sections of the IPC per annual cycle, and up to 150 (one hundred and fifty) requests for participation in the PPH pilot program may be performed for patent applications classified in each section of the IPC per annual cycle.

Therefore, the requests that exceed this limit and that are classified in section H of the IPC will be rejected. The PPH annual cycle ends on December 31, 2022 and, after that date, it will be possible to file new PPH requests for patent applications that are classified in section H of the IPC.

It is still possible to perform requests for patent applications classified in the other sections of the IPC, however, it is important to emphasize that this limit can be reached for the other sections of the IPC at any time.

In view of this, we suggest applying for the PPH as soon as possible for cases of interest.
