The Brazilian Patent and Trademark Office (BPTO) published the second edition of the Industrial Design Manual on September 12, 2023. The new guidelines will come into force on October 2, 2023.
This second version of the manual harmonizes the BPTO’s actions with the most effective international standards, offering to Applicants greater transparency during the process of analyzing industrial design applications.
As a highlight of the 2nd version of the Industrial Design Manual, the BPTO introduced the possibility of protection of industrial design that includes trademark signs or protection of the industrial design of the logo; protection of industrial design that includes textual elements of any nature, in any language; protection of static or dynamic graphical interfaces, icons and type font families; and three-dimensional configurations made up of parts without mechanical connection between them.
Furthermore, there was an expansion in the possibilities for representing the design of interest, such as the use of dotted lines to represent parts of the object that are not being indeed claimed.
Therefore, the second edition of the manual is a positive indication of changes towards a more favorable environment for innovation and protection of industrial designs in Brazil.
