BPTO extends the deadline for requesting the priority examination of patent applications concerning technologies related to COVID-19.

On July 1st, 2021, came into force Ordinance No. 29, of June 14, 2021, which was published in the Brazilian Industrial Property Gazette No. 2634. This Ordinance amends Resolution BPTO/PR No. 239/19 aiming to allow the request for priority examination of patent applications concerning technologies related to COVID-19, whose claimed subject-matter is directed to pharmaceutical products and processes, equipment, and/or materials for use in health aiming diagnosis, prophylaxis, and treatment of COVID-19.

According to Ordinance No. 29, the request for priority examination must be filed until December 31, 2021, by the applicant, patentee or third party (individual or legal entity), and the request must contain clarifications justifying the classification of the claimed subject-matter as a technology related to COVID-19.

It is important to emphasize that the priority examination expedites the prosecution of all procedures involved in a patent application before the Brazilian Patent Office, not being restricted to the technical examination.
