Adoption of version 2023 of NCL 12

After the postponement of implementation, the Brazillian Patent and Trademark Office (BPTO), through its Directorate of Trademarks, Industrial Designs and Geographical Indications, published this Wednesday (February 15th, 2023), a statement formalizing the adhesion to the 12th edition of the Nice International Classification (NCL(12) 2023).

At the 31st Meeting of Experts of the Union of Nice, the signatory countries of the Nice Agreement and the World Intellectual Property Organization (WIPO) opted to postpone the accession in some countries. This was essential for the BPTO have enough time to update the system, which must be in line with the new list of products and services.

The classification system is divided between products and services that must be indicated when filing a trademark application. To facilitate the classification, the BPTO provides an extensive list, which is not restricted.

Nice’s classification is reviewed and updated periodically to embrace new products and services. The 2023 version of the 12th edition, for example, brought the inclusion of some important – and increasingly common in daily services – such as “digital files authenticated by non-fungible tokens [NFTS]”, “car subscription services” and “provision of online guided virtual tourist tours”.
